"Putting aside the emotional appeal, a cold analysis of the facts doesn't support the charge. He did not show utter disregard for the rights of his child." But Kevin Baker, the Hialeah police officer whose report convinced Dade prosecutors to file charges, contends that is exactly what Rodriguez did.

"That kid deserved to live and she would be alive today if she had been in a car seat," the traffic accident investigator said. "She had no choice in the matter. It was up to the parents to guide her. They let her down." Rodriguez and his wife, Carmen, say the day Veronica died was the first time she was allowed to ride in a car without sitting in a car seat. The couple said the youngster was feverish and wanted to be held by her mother while her father drove to the store for groceries and medicine.

The Rodriguezes relented, leaving the safety seat behind in another car. The accident occurred on the way home from the store, within sight of the Rodriguez's modest apartment. Rodriguez was driving slowly, no more than 10 mph, when he turned into the path of an oncoming van but the impact and force of the crash flung Veronica from her mother's lap into the dashboard. The child's body, Baker said, acted as a human airbag for her mother, who was not wearing a seat belt and was injured seriously enough to spend a week in the hospital. Four hours after the accident, Veronica died from massive head injuries.

Her father, who also was not wearing a seat belt, was not seriously injured. Baker, a father of two who never before had investigated a child traffic fatality, said he is haunted by the vision of Veronica's battered body. He doesn't believe the child was sick that day, a contention supported by the autopsy. Anger rises in Baker's voice when he says parents must be held accountable for the safety of their children. Determined to deliver that message, the officer has convinced his state representative to file a bill raising the penalty from $32 to $250 for drivers who fail to secure child passengers into child restraints.

The bill also would require that points be assessed against a driver's license for violations. "Whenever you stop someone for not having their kid in a child restraint, that's the first thing out of their mouth how much is it going to cost and will I get points assessed against my license?" Baker said. "Maybe raising the penalty will make them think twice about not using it. Certainly charging them with vehicular homicide should." That legal tactic has drawn mixed reaction from highway safety organizations, staunch supporters of child restraint seats. Karen Gievers, who founded Florida's Operation SafeDrive, after an inattentive driver ran over and killed her jogging band, thinks such prosecutions will help other parents avoid mak-( ing the same costly mistake as Rodriguez.

"We have to get the point across how deadly cars are," the Miami lawyer said. "The more we get that point across the better off we'll all be." But Brian O'Neill, president of the Insurance Institute for High-t way Safety, finds such prosecu-i tions appalling. "It's very heavy-handed," he said. "God knows these people don't need to be punished anymore. They've suffered And God knows, they don't need, to be rehabilitated.
